Trump Asks Supreme Court to Pause Immunity Ruling in Jack Smith January 6 Case
President Trump on Monday asked the US Supreme Court to pause the immunity ruling in Jack Smith’s January 6 case in DC.
Last week a federal appeals court stacked with Biden judges denied Trump immunity in Special Counsel Jack Smith’s January 6 DC case.
The three-judge panel for the DC Circuit Court of Appeals ruled on Trump immunity claims: Florence Pan (Biden appointee), Michelle Childs (Biden appointee), and Karen Henderson (George W. Bush appointee).
“We have balanced former President Trump’s asserted interests in executive immunity against the vital public interests that favor allowing this prosecution to proceed,” the three-judge panel wrote.
“We conclude that ‘concerns of public policy, especially as illuminated by our history and the structure of our government’ compel the rejection of his claim of immunity in this case,” they wrote.
Trump’s lawyers argued that Trump is immune from federal prosecution for alleged ‘crimes’ committed while he served as US President.
“In 234 years of American history, no president ever faced criminal prosecution for his official acts. Until 19 days ago, no court had ever addressed whether immunity from such prosecution exists,” Trump’s lawyers wrote in last month’s filing, according to CBS News. “To this day, no appellate court has addressed it. The question stands among the most complex, intricate, and momentous issues that this Court will be called on to decide.”
I thought they agreed to take it up after the lower court ruling. Maybe they are just entertaining taking it up. Remember this was Jack "ass" Smith, who wanted to push it to the SC and for them to rule quickly (you know cuz he has marching orders to interfere in the election). Of course, they saw right through that and rejected Smith's request. If The SC refuses, it goes straight to an appeal process at the lower court which judging by Smith's frenzied actions, would seem to indicate that process would draw it out even longer.
If they rule Trump isn't immune, well neither is Obama. All it would take is a DA to bring charges on him. A double edged sword is being played with right now.
If the president doesn't have immunity for his official acts, so don't judges, DAs, or other government officials (including senators and reps).
Can you imagine . . . every judge, or DA, who released a criminal who went on to commit another crime subsequent to his release, being sued by the victims or their families ? That could be a fun retribution . . . but it would be the end of our country.
